Building Approval Certificate Applications
Should a building/structure be built without a building permit, the Building Act 2011 does not permit the City to issue one retrospectively. However recent changes to legislation allow local governments to issue a Building Approval Certificate for an unauthorised building/structure.
Where the unauthorised building/structure complies with relevant legislation, standard building construction practices, the Building Code of Australia and health and planning requirements, the City may consider issuing a Building Approval Certificate.
It should be noted, however, that it remains the prerogative of the City as to whether it will require the building to be pulled down and/or seek legal recourse.
