Section 70A Notifications
Under Section 70A of the Transfer of Land Act 1893, a condition of subdivision or development approval may require a notification to be lodged on a property’s Certificate of Title to make proprietors or prospective purchasers aware of a factor or condition affecting the use or enjoyment of the land, such as aircraft noise.
The procedure to place a notification on a Certificate of Title is generally as follows:
Step 1 - Download the notification form
Access and download the Section 70A notification e-form from the Landgate website.
Step 2 - Complete the form
Fill out the form in accordance with your development or subdivision approval, including the required notification wording. The form must be signed by the registered proprietor(s) and witnessed.
Step 3 - Submit the form to the City
Provide the completed and signed original form to the City of Belmont (in person at the City of Belmont Civic Centre or by post to Locked Bag 379, Cloverdale WA 6985).
Step 4 - City execution
The City will arrange for the form to be signed and sealed.
Step 5 - Collection
You will be contacted once the form is ready for collection.
Step 6 - Lodge with Landgate
Collect the signed form and lodge it with Landgate to register the notification on the Certificate of Title.
