Unapproved buildings and structures
If you build a building or structure without a building permit, the
Building Act 2011 does not allow the City of Belmont to issue a permit retrospectively. Recent changes to legislation do allow local governments to issue a Building Approval Certificate (Class 1 or 10 or 2 to 9 buildings that does not require an Occupancy Permit) or an Occupancy Permit (s.51 Unapproved works – Class 2 to 9 buildings) for an eligible unauthorised building(s) or structure(s).
You can apply for a Building Approval Certificate (Class 1 or 10) or an Occupancy Permit (s.51 Unapproved works – Class 2 to 9 buildings) for an unauthorised building or structure if it complies with:
- All relevant legislation
- Standard building construction practices
- The current versions of the Building Codes of Australia
- Health and Planning requirements
Please note, the City reserves the right to decide whether the building or structure will need to be pulled down and whether any legal proceedings will follow.
