If your subdivision application is approved, the WAPC issues conditions outlining the requirements which need to be met for your approval to be valid. These conditions need to be cleared by various authorities, including the City of Belmont.
You can lodge your application for clearance of local government conditions with the City. You will need to include:
- A cover letter detailing the conditions to be cleared
- Details of how each condition has been cleared, including any evidence
- A copy of the deposited plan
- Payment for the relevant application fee
When your application has been received, the City will review the WAPC conditions and the details of your application, and may need to complete a site inspection. If this process finds that a condition has not been met, the City may need to charge an extra $50 reinspection fee, or refuse the clearance application.
You may have heard of two types of strata subdivision:
- Survey-strata subdivision – where no buildings are shown on the plan, even if they exist on the lots;
- Built-strata subdivision – where lots are defined by a building shown on the strata plan.
Built-strata subdivision is often used with older strata developments where each dwelling will form a strata lot. Land outside each dwelling will either be identified as a part of a lot or as common property.
If you apply for built-strata subdivision approval, in most cases your application will be determined by the City of Belmont under delegation from the WAPC. The WAPC will determine your application if it involves the creation of a vacant lot, vacant air-stratas in multi-tiered strata schemes or a leasehold scheme.
Types of built-strata division which do not need approval
You may not need built-strata subdivision approval if all of these criteria apply:
- The area of the land parcel is no more than 2,500m²;
- The lots are to be used for residential purposes and each lot contains only one dwelling;
- There are no more than five lots in the strata;
- The land is within a residential zone and conforms with the local planning scheme.
How to apply for built-strata subdivision
Here is a summary of the application process:
- You can submit a built-strata application using a Form 15A (formerly a Form 24);
- The City of Belmont (or the WAPC if applicable) will review your application and issue a decision, which may or may not include conditions of approval;
- If your application is approved, you need to address any conditions before applying for a certificate of endorsement via a Form 15C (formerly a Form 26).
